This Privacy Policy explains how Intersect Technologies, LLC (“Intersect”) collects, uses, and discloses information you provide to us or which we otherwise collect (“Information”), including “Personal Data” by which we mean Information that allows us to determine your identity.

This Privacy Policy applies to www.intersecttechnologies.com (the “Site”). By using the Site, our Services, or interacting with us in any way, you consent to our Privacy Policy. If you do not consent to our Privacy Policy, please do not use our Site, our Services or interact with us in other ways. The website interface that provides our product and services to our customers is governed by customer agreements. The use of our public-facing website is subject to the Intersect Website Terms and Conditions. This Privacy Policy is incorporated into both the Intersect Website Terms and Conditions and the applicable customer agreements.

  1. Data Collection
    There are two primary ways in which Intersect collects Information about you: through Interactions and through Services as explained below.
    1. Interactions. When you interact online or offline with Intersect, we may receive your Information, including your Personal Data. We collect Information about you from other sources such as public databases, commercial data sources, joint marketing partners, resellers, managed services providers and other partners, social media platforms, and conference/event hosts. We refer collectively to these contacts as “Interactions”.
      1. How We Collect Information via Your Interactions. We (or others acting on our behalf) may collect your Information, including your Personal Data, through Interactions. We collect Personal Data in various ways, such as when you provide it to us or others provide it to us when we receive marketing leads or other information. IP addresses are also collected on an automated basis through your use of the website services using cookies, web beacons, and like technologies. We may infer your location from your IP address.
      2. Information We Receive from Third Parties. We may purchase data about our customers from third parties and combine it with information we already have about you, to create more tailored products.
      3. Additional Third-party Providers and Their Services. We use additional services from third parties such as Google to deliver targeted ads to you during your online experience. We work with third parties to deliver targeted advertisements to you and others who visit their platforms and who may be interested in our Services. When we do, we share your Personal Data with the third party, who promptly hashes it before use to protect your privacy. You may still see our non-targeted advertisements while you are online if your interest settings on such third-party platforms are aligned to an audience segment (pre-defined by the third-party platforms) associated with our business. We do not control whether these ads are displayed to you. Likewise, we have no control over, and are not responsible for, the cookies, tracking technologies, or advertising processes of third-party services that you may visit, including the services of any of our partners or advertising affiliates.       4. How We Use Information Collected from Interactions. Intersect uses the Information we collect from your Interactions to deliver services to you in accordance with our terms, to fulfill our contractual and legal obligations, or to “pursue legitimate business interests”.
      5. Opting Out of Marketing Emails. If you no longer want to receive marketing emails from Intersect on a go-forward basis, please submit your request through our online data request portal. Alternatively, you may use the “unsubscribe” feature in our email messages.
    2. Services We also collect Information, including Personal Data, when providing our Services. We may ask you for this Information directly, or in some cases, we may collect it when certain features are enabled.
      1. What We Collect via Our Services and How We Use It. We collect and process different types of data when you deploy our Services in order to fulfill our contractual and legal obligations and operate our business or fulfill other legitimate interests.
  2. How Intersect Shares Your Information. Intersect may disclose your Information to others in the following ways:
    1. Affiliates. We may disclose Information to our affiliates subject to this Privacy Policy so that they can help market, sell, and support our Services. Intersect is the party responsible for the management of jointly used Personal Data.
    2. Service Providers. We may disclose Information to our service providers (e.g., infrastructure as a service, order fulfillment, professional/customer/support services), pursuant to written agreements with confidentiality, privacy, and security obligations.
    3. Partners and Clients. We may disclose Information to our partners and clients pursuant to written agreements with confidentiality, privacy, and security obligations.
    4. Compliance and Safety. We may disclose Information as necessary or appropriate under applicable laws (including laws outside your country of residence) to: comply with legal process or requirements; respond to requests from public or government authorities (including those outside your country of residence); enforce our terms and conditions; and protect our operations, rights and safety, and that of you and others, as needed.

Merger, Sale, etc. We may disclose Information in the event of a proposed or actual corporate or financing transaction, such as a reorganization, merger, sale, joint venture, assignment, transfer, or disposition of all or any portion of Intersect business, assets, or stock (including Information regarding any bankruptcy or similar proceedings).
  3. How We Secure Your Information. Intersect takes reasonable technical and organizational measures to safeguard Personal Data against loss, theft, and unauthorized access, disclosure, alteration, misuse, or destruction. Unfortunately, no data transmission, software, or storage system can be guaranteed to be 100% secure. If you have reason to believe that your Personal Data may no longer be secure, please notify us immediately. If Intersect learns of a breach of its systems, Intersect may notify you or others consistent with applicable law and/or as agreed in our contract with you. Intersect may communicate with you electronically regarding privacy and security issues affecting Information collected or stored by us
  4. Intersect Also Observes the Following Practices.
    1. Retention Period. We retain your Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or not prohibited by applicable law. We retain your contract information for the duration of your agreement with us and thereafter as required or permitted by law. We keep a record of your data requests, including your requests to opt out of marketing communications, to honor them in the future.
    2. Use of Intersect Offerings by Minors. Intersect Offerings are not directed to individuals 16 and under or those not of the age of majority in your jurisdiction, and we request that these individuals, or others on their behalf, not provide us with their Information.
  5. Your Rights. In certain locations, you may have rights under data protection law, such as to request access to or correction, deletion, or transfer of your Personal Data, or to object to or restrict Intersect from using it for certain purposes.
    1. Supplemental Terms and Conditions for Certain Regions
      1. International Use. Our Services are governed by the laws of the United States. Our Site is intended for United States Businesses and to be accessed from a physical location within the United States only. We make no representation that our Services are operated in accordance with the laws of any other nation. If you access this website from outside the United States, you do so at your own risk. By sending us your data, you consent to its transfer to and storage within the United States. Those who access the Site from outside the United States do so on their own initiative and are responsible for compliance with local laws, rules, and regulations.
      2. California. If you are a California resident, California law may provide you with specific rights regarding your personal information, subject to certain exceptions, including the right to know about the personal information a business collects about you, the right to request that we delete the personal information we collect from you, and the right to non-discrimination for exercising your rights. For purposes of California law, personal information means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer or household.
